Terms and Conditions
1.0. Scope
1.1. The MSME Retreat International (“TMRI”) owns The MSME Retreat (TMR), a project aimed at promoting and supporting the sustainable growth and development of Micro, Small and Medium businesses in Nigeria and Africa. The services of our business are currently provided on the website www.msmeretreat.com, but may be provided on different websites or applications in the future.
1.2. Users must first be registered, accept both the Terms and Conditions and the Privacy Policy of our services before access could be granted to the full and complete products and services features on the website. Thereafter all registered users shall be referred to as “Member”.
1.3. Members will have the opportunity to create and regularly update their personal profile on the TMR platform.
1.4. Members authorize TMRI and her sponsors to use their personal and business information for advertorial and promotional purposes only on matters directly related to The MSME Retreat.
1.5. Members authorize TMRI to take photographs and videos of them and their business represented during The MSME Retreat event and use same as promotional materials during and after the event. All these photographs and videos so taken are and remains the property of TMRI.
1.6. Members authorize TMRI to transmit their personal and business information which include Name, Phone Number, Email Address, Business Name, Business Location and any other information as deemed necessary to all the partners and sponsors of The MSME Retreat event for marketing purposes only.
1.7. TMR may carry out changes to the website or service, or suspend the service, without notice.
2.0. TMRI’s rights and obligations
2.1. Members acknowledge that the relationship between individual member and TMRI is governed by the privacy policy and this general terms and conditions, both available on the website.
2.2. TMRI will publish on the website the information provided by the member. The member will be responsible for constantly updating their profile and other posts.
2.3. TMRI is authorized to display members’ posts and profile on the TMR website and other members will at their own discretion and responsibility have direct interaction and transactional dealings with other members.
2.4. TMRI reserves the right to organize and host The MSME Retreat event at any time and location deemed fit and with whatever content so deemed fit.
2.5. TMRI reserves the right to admit users as members on the TMR platform.
2.6. TMRI reserves the right to terminate relationship with any member for violating any of the terms set herein or any other terms of TMRI as would be provided and updated from time to time.
2.7. TMRI reserves the right to set the payable fees for the TRM events or any of its services.
2.8. TMRI reserves the right to determine whether or not to give grant award, the number of grant beneficiaries, the grant amount and the mode of selecting the grant beneficiaries.
2.9. Only paid participants shall have the opportunity to apply for grants and other valuable perks during the TMR events. Free participants shall ONLY have free access to attend the TMR event and nothing more.
2.10. In the event that TMRI is presenting grant award at the TMR event, the grant awards shall be in compliance with the “Grant Agreement” which shall be executed by ALL grant beneficiaries.
2.11. TMRI reserves the right to add or remove any of the services offered on the website and also reserves the right to determine number of beneficiaries and/or participants.
3.0. Member’s rights and obligations
3.1. Members are obliged to provide all the information necessary when registering and updating their profile on www.msmeretreat.com. This should include but not limited to, personal information, business information, photos, and posts on groups, forum and chat. Members must never knowingly deceive other members by misrepresenting their profile and information. Members must ensure that their information is detailed and accurate at all times.
3.2. Members guarantee that information provided on TMR platform relating to products and services satisfies all legal/regulatory requirements including the laws of the Federal Republic of Nigeria, and in particular satisfies information requirements for safety standards and consumer protection.
3.3. Members will be responsible for keeping an up-to-date inventory of all their products and services listed on TMR platform.
3.4. Members guarantee that all information provided does not violate any third party's copyright.
3.5. Only registered members are eligible to attend any TMR event. Members reserve the right to choose whether or not to attend any TMR event.
4.0. Charges and Fees
4.1. There is no applicable membership or registration fee at the moment.
4.2. All free participants shall pay such fee set by TMRI in order to access their certificate of participation and other event materials.
4.3. TMRI reserves the right to set applicable fees and charges for the use of the exhibition spaces by participants willing to display their products and services during any TMR events.
4.4. TMRI reserves the right to introduce, set and adjust fees at any moment deemed fit. TMRI will give the Members adequate notice of any fee so introduced, in writing.
4.5. TMR events may attract participation fees which are subject to change from time to time.
5.0. Grant Awards
5.1. TMRI reserves the right to determine whether or not to give grant award, the number of grant beneficiaries, the grant amount and the mode of selecting the grant beneficiaries.
5.2. In the event that TMRI is presenting grant award at the TMR event, the grant awards shall be in compliance with the “Grant Agreement” which shall be executed by ALL grant beneficiaries.
5.3. Any selected grant beneficiary not present at the grant presentation event shall be automatically disqualified.
6.0. Members’ Payment
6.1. All payments to TMRI are made electronically through card/online payment.
6.2. All payment shall attract a Value Added Tax (VAT) charge equal to 7.5% or as may be prescribed by the Federal Government of Nigeria from time to time.
6.3. Members shall bear the risk of abuse of the payment medium (card fraud).
7.0. Refund Policy
Request for refund of any payment made to TMRI by any member shall be wholly subjected to the following conditions:
7.1. That the service(s) paid for has not already been executed.
7.2. That the request for refund is made within 72 hours after payment.
7.3. That the member provide a proof that services for which the payment was made has not been received or utilized.
7.4. Having satisfied the conditions precedence, the member seeking a payment refund shall send an official request to msmeretreat@gmail.com Please attach your evidence of payment and the confirmation email from TMR.
7.5. Upon a successful review of the request for refund, a 30% deduction is made from the total amount paid to cover payment processing fee and service charge already paid to the third party payment gateway. You will be notified to provide the bank account details where you want TMR to pay in the refund.
7.6. The refund process take a minimum of 20 working days from the date of receiving the refund request.
8.0. Liability
8.1. Members indemnify TMRI and TMR from all claims arising in relation to information presented by them on this platform and transactions carried out via this platform. Member further indemnifies TMRI and TMR from third parties' claims resulting from any violation of laws and regulations by the member.
8.2. TMRI cannot guarantee that its service will be free from all malfunctions, but will exercise all reasonable care and skill to resolve any such case.
8.3. All payments on this platform shall attract VAT as prescribed by the Federal Republic of Nigeria.
9.0. Privacy
9.1. Members are obliged to treat confidentially their contents and login details, as well as all other information and data they acquire in connection with using this platform, and not use it for purposes outside the scope of this agreement or pass it on to third parties except as stated in this term.
10.0. Terms and termination
10.1. This agreement is valid as soon as the User signs up on the TMR platform and remains valid indefinitely, until termination by either party. Termination can occur at any time, with a period of notice of one month, in writing, by email or post. The right to immediate termination by either party for important cause remains unaffected.
10.2. The right to immediate termination in particular covers the case where the member repeatedly receives negative ratings and reviews on the website, and when these are not obviously unjustified. Repeatedly providing misleading information or withholding required information is also grounds for immediate termination. Typos, mistakes and transmission errors are excluded from this, as long as they are not caused with intent or by gross negligence.
11.0. General
11.1. If a single clause in this terms and conditions is invalid, both parties will endeavor to replace the invalid clause by a valid one that represents as closely as possible the intended economic meaning of the invalid clause. The validity of the rest of the terms remains unaffected. This applies in particular if the terms and conditions is found to be incomplete.
11.2. TMRI reserves the right to modify its general terms and conditions without giving any justification.
11.3. The modified terms and conditions are and remain binding on the member.
11.4. Any terms and conditions governing the products and services or the general operation of the member's business are not part of this agreement unless TMRI expressly agrees to adhere to them in writing.
